Philip Morris appeals ruling: Seeks to subtract punitive damages of $3 billion

If Philip Morris USA has its way, the State of Illinois will lose $3 billion in punitive damages related to a Downstate class-action lawsuit over the sale of light cigarettes.

The maker of Marlboro cigarettes said it asked the Cook County Circuit Court late Friday to prevent the state from collecting punitive damages. The award was part of a $10.1 billion judgment against the company on March 21 for deceiving Illinois smokers into believing light cigarettes were safer than regular varieties.

The threat stirred up state politicians across the nation. States are depending on the tobacco payments to shore up their budgets. Indeed, a number of state attorneys general plan to file an amicus, or friend of the court, brief early next week in Madison County on behalf of Philip Morris' attempt to lower the bond.

This is too rich. Having driven Phillip Morris into a ditch, the States (Illinois isn't alone in this, it's the same story in New York) are about to fall into the that same ditch of their own making. Serves 'em right!

On Friday, Washington state Attorney General Christine Gregoire and 45 other state attorneys general notified Philip Morris that they will bring legal action if the next payment is late. Gregoire also said she plans to file a brief in Illinois supporting Philip Morris's request for a lower appeal bond.

"It's not only important that we get the payment, but that we get the payment in a timely manner," Gregoire said Friday. Washington's $53 million, due April 15, is already budgeted for health care and tobacco prevention programs.
